Hohfeld’s analysis on the different types of rights and duties is highly influential in analytical legal theory, and it is considered as a fundamental theory in AI&Law and normative multi-agent systems. Yet a century later, the formalization of this theory remains, in various ways, unresolved. In this paper I provide a formal analysis of how the working of a system containing Hohfeldian rights and duties can be delineated. This formalization starts from using the same tools as the classical ones by (...) Kanger and Lindahl used, but instead of focusing on the algebraic features of rights and duties, it aims at providing a comprehensive analysis of what these rights and duties actually are and how they behave and at saying something substantial on Power too—maintaining all along the Hohfeldian intentions that these rights and duties are sui generis and inherently relational. Although he initially walked onto the ward he became very distressed and asked for sedation. After much discussion, this man was deeply sedated, and after some harrowing days, died. Was it right to provide terminal sedation? What should the threshold be for such treatment? How should our personal reservations affect how we approach the distressed patient in an end-of-life situation?

This paper examines the controversy between Franz von Baader and Schelling as it takes place in Schelling’s lecture course Das System der Weltalter. This particular instance of their disagreement involves Schelling criticising Baader for his notion of the biblical Elohim as divine proxies. The paper first provides a background to Baader-Schelling philosophical feud before examining Schelling’s remarks against Baader in the System der Weltalter. Then, Baader’s writings on Elohim are looked into in the light of their connection to Baader’s conception (...) of creation as falling-away and Baader’s source for interpreting Elohim as proxies, including Saint Martin and Kabbalah. Thereafter, Schelling’s criticism of Baader is analysed and interpreted in the context of the System der Weltalter. The paper aims to achieve several things: to show the presence of distorted kabbalistic influence in Baader and its discussion in Schelling; to revise Koslowski’s view on Baader’s creation narrative by pointing out how Baader’s Elohim/divine proxies function to form a rather dualistic relation between God and creation; and to interpret Schelling’s convoluted and difficult reply to Baader displaying that at stake between the two thinkers were questions of God’s ineffability and freedom as well as God’s involvement into creation. The article is devoted to Berdyaev's first Italian journey, which had a "tremendous influence" both on his creative destiny and on the development of his aesthetic views. It is significant that one of the defining motives for visiting Italy was his desire to "return to his homeland impressed by the greatest beauty"! Since the first journey of the philosopher was connected with Florence, it seemed appropriate to pay due attention to the achievements of this city and its decisive contribution to (...) the formation and development of the culture of the Renaissance. The formation of revivalist principles in Florentine literature and fine arts is shown; the formation of theory (Alberti) and the history of art (Vasari), as well as a number of cultural phenomena accompanying these processes, which ultimately determined the artistic and aesthetic appearance of Florence and turned it into the capital of the Italian Renaissance. As a result, this makes it possible to fully understand and appreciate Berdyaev’s choice of this particular city, especially since Florence not only made “the strongest impression” on him, but also became the “key” to understanding both Florentine art proper and artistic-aesthetic culture Italian Renaissance. This is the first attempt in Russian literature to consider and analyze Berdyaev's Florentine journey as one of the sources of his creative heritage, which has not yet become the subject of special study. The relevance of topic is also determined by the existing confusion on this issue, which the article is aimed at overcoming. (shrink)

This paper examines the available evidence on one of the most radical ideas in the history of eugenics and utopianism. In the mid-1920s, the zoology professor Ilia Ivanov submitted to the Soviet government a project for hybridizing humans and apes by means of artificial insemination. He received substantial financing and organized expeditions to Africa to catch apes for his experiments. His project caused an international sensation. The American Association for the Advancement of Atheism announced its fund-raising campaign to support Ivanov’s (...) project but gave it a scandalously racist interpretation. Ivanov’s own motivation remained unclear, as did the motivation of those in the Bolshevik government who supported Ivanov until his arrest in 1930. This paper discusses three hypothetical reasons for Ivanov’s adventure: first, hybridization between humans and apes, should it be successful, would support the atheist propaganda of the Bolsheviks; second, regardless of the success of hybridization, Ivanov would catch and bring to Russia apes, which were necessary for the rejuvenation programs that were fashionable among the Bolshevik elite; and third, hybridization, should it be successful, would pave the way to the New Socialist Man whose ‘construction by scientific means’ was the official purpose of the Bolsheviks. Ivanov’s ideas were arguably important for the American proponent of reform eugenics, Herman Muller, and for the Soviet anthropologist Boris Porshnev. (shrink)

One of the main trends of modern society is a marked increase of the theoretical interest to the sphere of mythology and the theory of myth. And in light of globalization approaches explicitly focus on the impact study of the regional aspects of social phenomena. In this regard, in regional studies of mythology appear attempts seen the myth city's as a socially formalized knowledge about the city or region, a strong regulatory and mobilization element in society, which is capable of (...) forming a regional entity and identity. A problem is in that every city has the own myths and specific municipal culture. It can be one of reasons of conflicts at co-operation of townspeople of different regions because all of us are inclined to identify itself with a sub-group on the sign of place of inhabitation, line of business or the world view. Thus, at all cities have different myths and symbols. We are inclined to see our city as city of the chosen townspeople, while other cities and regions are inhabited by demons and monsters. The article suggests to consider the city like a self-valuable phenomenon. Theoretical analyses of person–environment interaction describe complex models, addressing different levels of social systems, while models of the sense of community provide a base for transferring views of this interaction to the national level. This paper presents two studies that explored the structure of the sense of country and its relation to emigration plans and social identification. Study 1 involved 1,005 adults from Latvia. The Sense of Country Inventory included influence, perceived opportunities, belonging, and spatiotemporal commitment as the components of (...) this sense. The bifactor model demonstrated the best fit and confirmed the general factor, integrating components of the sense of country, and specific factors, emphasizing its complexity. The validation demonstrated that the general sense of country is the main negative predictor of emigration plans. Study 2 included 247 participants who completed the SOCI and Identification With All Humanity Scale. Correlating with national identification, the sense of country negatively predicted emigration plans that reflected the social identity continuity pathway. In turn, a negative relationship between the sense of country and global identification, which positively predicted emigration plans, revealed a social identity gain pathway. Together, the studies present the integrative nature of the sense of country and its links to emigration plans and national and global social identification. (shrink)

Tracing this intertextuality from the Socratic authors to Boethius, the book shows how Greek and Roman protreptics define philosophy as a revisionary form of education, articulate the ultimate goals of this education, and associate their authors and audiences with philosophy as a new discursive practice and a new way (...) of living.
